Shivani Bhatnagar case: RK Sharma acquitted
New Delhi: Former Indian Police Service (IPS) officer RK Sharma and two others have been acquitted by the Delhi High Court on Wednesday in the Shivani Bhatnagar murder case giving the trio the benefit of doubt.
While Sharma, Sri Bhagwan, Satya Prakash have been acquitted, the court upheld the life sentence for Pradeep Sharma, who actually killed Shivani.
The two-judge division bench of justices BD Ahmed and Manmohan Singh, which had reserved the verdict on December 21 2010, took into account Sharma’s service record and found it to be exemplary.
Sharma, who has been serving his jail term Delhi’s Tihar Jail for the last nine years, and three others had challenged their conviction and sentencing in the murder case by the trial court.
Sharma’s counsel had argued there were several missing links, including the call records, in the chain of circumstances and the record was tampered with to implicate him.
The lawyer had sought acquittal of his client on the ground of lacunae in the transcript of the mobile phone calls between his client and other accomplices to substantiate his allegation that the police had fabricated the call records.
Lawyer of Satya Prakash Sarfaraz said, “The motive of the murder was Shivani’s relationship with RK Sharma but the court said the evidence has not been established.”
Standing Counsel (Criminal) Pawan Sharma had countered the defence submission contending the accused was posted in the Prime Minister’s Office and if any call record was tampered with at all, it was done by Sharma.
Shivani, an Indian Express journalist, was murdered on January 23, 1999, in her Nav Kunj Apartment at IP Extension in East Delhi. The court had slapped a fine of Rs 20,000 on RK Sharma, while the other three were fined Rs 10,000 each in 2008.
Sharma was posted in the Prime Minister’s Office during the tenure of prime minister IK Gujral when he first met Shivani.
